According to the New York Post, the Columbian pop star's Spanish-language single topped the Latin Billboard chart in 2010 and sold 5 million copies worldwide. Judge Alvin Hellerstein ruled Tuesday that it ripped off a song written roughly two decades ago by Ramon Arias Vasquez, "Loca con su Tiguere." Conversely, he ruled that the English language version did not infringe.
Mayimba Music, the rights holders of Arias' work, did not sue the artist herself, but rather her song's distributors, Sony Corp of America.
Reuters reported that both versions of the song "revolve around a love triangle in which the singers are poor and the opposing suitors are rich, a theme expressed in Arias's title. Shakira's version uses the word 'tigre' (tiger) instead of 'tiguere,' which is Dominican slang, but Hellerstein said the meaning was the same."
Complicating things somewhat, Shakira's song features Dominican rapper Eduard Edwin Bello Pou, aka "El Cata," who originally released a hip hop single called "Loca con su Tiguere" in 2007. That single was also distributed by Sony, and was used at the basis for Shakira's "Loca."
"There is no dispute that Shakira's version of the song was based on Bello's version," the judge wrote in the ruling. "Accordingly, I find that, since Bello had copied Arias, whoever wrote Shakira's version of the song also indirectly copied Arias."
Arias has long accused he wrote the song in the 1990's and that after he showed it to Bello he stole it and claimed it as his own. Bello denies this version of the story, and said he wrote it himself.
Future hearings will determine any damages incurred by Mayimba Music.

You get the highly evolved musical madness of guitarist Duffy Kane. Duffy is a man who just wants to play guitar. His music is as diverse as he is American. His fever for the guitar is evident in his sheer electricity on stage. Like a volcano that is ready to erupt… Duffy is the real deal on stage and off.Born in Weirton WV, Duffy Kane was surrounded by the sounds of Jazz, Classical, Blues and Country. A classically trained violist; he altered his knowledge of the violin and easily transferred it to the guitar. A self taught guitar player with a classically trained ear is the foundation for Duffy’s provocative guitar style. His mother was a guitar player. When Duffy was a kid there was a beat up guitar that sat in the corner of his living room. Duffy’s new album, “Dead Man Walking”, set for release June 30, 2014 on Freedom Train Records, touches on issues that are important to every American but isn’t preachy. Duffy says, “I write music that will hopefully ennoble and uplift the listener with truth, colorful harmony, and melodies that will be memorable to them.”
The debut single entitled “Sweeter Than” was written in 1998 but never recorded til now. The song is an excellent example of Duffy's signature sound with it's hard driving rhythm, playful & harmonic volley of guitar notes and soulful vocals.
His second single, “Why My Road” is a slow cooked tribute to Texas Bluesman, Stevie Ray Vaughan. Kane’s musicianship is based deep within the roots of American Blues & Jazz while simultaneously showcasing his original signature sound.
Duffy’s new work aims at powerful and wins. The songs will make you laugh, think, and cry and will hopefully enlighten. Why Radio is Stuck in the Middle of a Streaming Pincer Movement
2014 will be another year of growth and of controversy for streaming, with much of the debate set to focus on how streaming may, or may not, cannibalize download sales. Theevidence from Sweden and from the US so far suggests that streaming revenues may indeed grow at the direct expense of downloads. But while we may be some way off from a definitive judgment on that issue, there is one cannibalization threat that is looking increasingly incontrovertible, yet has got far less attention: the cannibalization of radio. In fact radio faces a two-pronged attack on its two heartlands, the home and the car.
The Home Front
There are many forms of streaming service and each sub-segment is eager to declare its uniqueness. Spotify and Pandora practically fall over themselves to explain how different they are. And indeed, in many ways they are, but what they have in common is that they are both direct competitors for radio listening time. While they do not compete for all radio listening, nor for all radio listeners, they compete for much of the listening of some of the most valuable listeners. Indeed streaming is looking more like radio with every passing day. The intensifying focus on curation as a means of making sense of 30 million songs is leading to on-demand services delivering a richer suite of lean-back, programmed and semi-programmed experiences. In doing so the competitive threat to radio intensifies. Whereas radio broadcasters can rightly claim that radio delivers a low effort, lean back listening experience, streaming services now wear those clothes too and they are not going to relinquish them.
Where things have really heated up though is the surge in streaming playback technology for the home. Companies like Sonos and Pure have pioneered in-home streaming technology and CES saw this whole sector upping its game. Music hi-fi is disappearing out of the home and these companies plan to bring it back with streaming at its core. While radio is a key component of these devices, any hardware that gives a user the choice between traditional radio and interactive streaming is going to mean that radio is directly competing for listening time on that very device. The home is one of radio’s heartlands, and broadcasters are now having to fend off the unwanted attentions of streaming music services establishing an in-home beachhead with consumer adoption of home streaming devices.
Digital Radio Fragmentation Plays Into the Hands of Streaming Services
Dedicated digital radio devices such as DAB and satellite radio players have only found traction in a handful of markets, with the US and UK notable exceptions at the forefront. But international and domestic squabbles over competing digital radio standards mean that the global digital radio landscape is a fragmented mess of half-baked trials and aborted roll outs. All the while internet streaming adoption accelerates on smartphones and tablets. Radio may even buckle under the weight of this app invasion. The more radio broadcasters rely on internet streaming for digital strategy, the more they put themselves directly in competition with streaming services, both on-demand and interactive radio.
The Battle for the Car
If the onslaught on the home was not enough, the growth of interactive car dashboards means that streaming services are getting straight into the car too. In the US SiriusXM has long been held up as a standout success story for digital content with 25.6 million paying subscribers outshining any on demand music service by a country mile. But the same app invasion that is threating radio on smartphones and tablets is now pouring into the car via interactive dashboards. Car manufacturers are striking up deals at a bewildering rate with streaming providers with Pandora and Spotify being particularly active. SiriusXM had a decent run at things, offering a truly national radio experience in the US, but now more and more consumers will start wondering why they need to pay $15 a month when they can get Pandora and Songza for free.
The Free Music Land Grab
Thus radio finds itself locked in a streaming music technology pincer movement that threatens it like never before. Radio broadcasters have countless assets at their disposal – talk radio, DJs, market-leading programming expertise – but they cannot rely on these alone anymore. They have to up their innovation ante posthaste. They also face a further and utterly crucial disruptive threat from streaming: the free music land grab.
Spotify and Apple only offer free music as a means to sell their core products. Advertising revenue is a nice way of covering some costs but is not their lifeblood in the way it is for commercial broadcasters. This means that they can be more cavalier in their ad sales strategies and undercut radio broadcasters for business with rates that might not be sustainable for a commercial broadcaster. 2014 will see these two powerhouses pursue aggressive advertiser strategies and when coupled with Pandora’s burgeoning ad sales record, traditional broadcasters may find themselves becoming collateral damage in the free music land grab.
Is 2014 a Napster Year for Radio?
2014 will be an important year for streaming, but it will be even more pivotal for radio. It is far too early in the development of streaming to say that this is a make or break year for radio, but it is fair to say that 2014 looks and smells for radio a lot like 1999 did for the music industry. Back then the labels failed to respond to Napster with innovation and they spent the next decade paying the price. Radio broadcasters would be well served to –learn from the labels’ mistake.

Bill Cosby Tapped to Star in Family Comedy at NBC
Comedy veteran would star as the patriarch of a multi-generational family
Bill Cosby could soon find himself in a very familiar role: Starring in a family comedy.
The actor and comedian has entered a deal with NBC to lead a half-hour familial sitcom. Writers are currently being hired for the project, which has no studio attached to it yet.

The new venture will find Cosby at the head of a multi-generational family.
Cosby, who recently headlined the Comedy Central special “Far From Finished,” starred in “The Cosby Show” on NBC from 1984 to 1992 and “Cosby” on CBS from 1996 to 2000.
Cosby discussed the project in November, saying that he hoped to bring “warmth, and love, and surprise” to the comedy.
“I want to be able to deliver a wonderful show to [a] network,” Cosby said. “Because there is a viewership out there that wants to see comedy, and warmth, and love, and surprise, and cleverness, without going into the party attitude.
“They would like to see a married couple that acts like they love each other, warts and all, children who respect the parenting, and the comedy of people who make mistakes,” Cosby added. “Warmth and forgiveness. So I hope to get that opportunity, and I will deliver the best of Cosby, and that will be a series, I assume, that we could get enough people week after week after week to tune in to, to come along with us.”

Submissions are now open for artists to perform at the2014 IMR Indie Music Festival.
Calling all artists to perform at the 2014 IMR Indie Music Festival located in Atlanta, GA in June of 2014. The website announces June 12th through the 15th as official dates, but we’ve got some special things lined up and may have a full week of music!
Previous artists of this festival have played at other festivals including the Hijacking Music Festival, Counterpoint, Bonnaroo, Moogfest, Coachella, Tomorrowland, and more. This year’s line up will continue in it’s tradition of great artists from all over the world, so please take the time to submit while there are still spots left.
